1. Acceptance of terms
By creating an account on castingstudio.ai, you agree to these Terms of Service. If you do not agree, do not use the platform.
2. Platform overview
castingstudio.ai is a marketplace that connects talent (individuals who license their AI-generated likeness) with creators (companies and individuals who license that likeness for approved uses). We facilitate transactions but are not a party to license agreements between talent and creators.
3. Talent accounts
To list as talent you must be 18 years or older and complete identity verification via Veriff. By uploading your photos and completing onboarding, you grant castingstudio.ai a limited license to generate and host your AI avatar for the purpose of facilitating licenses. You retain full ownership of your likeness.
4. Creator accounts
Creator accounts require a paid monthly subscription. By subscribing you gain access to browse talent and purchase individual licenses. Each license is a separate legally binding agreement between you and the talent.
5. Licenses
Each license specifies the category, territory, duration and exclusivity terms. Licenses are non-refundable once the DocuSign agreement is signed by both parties. Licenses expire at the agreed end date and must be renewed to continue use.
6. Prohibited uses
You may not use licensed avatars for: illegal content, content that defames the talent, political advertising without the talent's explicit written consent, adult content unless the talent has specifically enabled this category, or any use outside the scope of the agreed license.
7. Platform fees
castingstudio.ai charges a 20% platform fee on all license transactions. This fee is deducted automatically at the time of payment. Creator subscription fees are non-refundable.
8. Payouts
Talent receives 80% of each license fee. Payouts are processed via Stripe or cryptocurrency wallet as selected by the talent. castingstudio.ai is not responsible for delays caused by third-party payment processors.
9. Misuse and disputes
Talent may report misuse of their avatar through the platform. castingstudio.ai will review all reports within 24 hours. Confirmed misuse results in immediate license termination and account suspension. castingstudio.ai reserves the right to pursue legal remedies on behalf of affected talent.
10. Account termination
Either party may terminate their account at any time. Active licenses remain valid until their agreed expiry date regardless of account status. castingstudio.ai reserves the right to terminate accounts that violate these terms.
11. Limitation of liability
castingstudio.ai is not liable for any indirect, incidental or consequential damages arising from use of the platform. Our total liability is limited to the fees paid by you in the 12 months preceding the claim.
12. Governing law
These terms are governed by the laws of Delaware, United States. Any disputes shall be resolved through binding arbitration.
13. Changes to terms
We may update these terms from time to time. We will notify you of significant changes via email. Continued use of the platform after changes constitutes acceptance.
